By using the Service, you represent and warrant that:

  • You are not located in a country that is subject to a U.S. government embargo.

3. Account Registration and Security

  • You are responsible for all activities that occur under your account.

4. Description of Service and Disclaimer

Mantravid.com provides an AI-powered data analysis platform. You submit data, and our system, utilizing third-party APIs, processes that data to generate analytical results ("Results").

YOU ACKNOWLEDGE THAT AI MODELS MAY PRODUCE INACCURATE, INCOMPLETE, OR MISLEADING OUTPUTS. THE SERVICE AND ANY RESULTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ACCURACY, RELIABILITY, OR COMPLETENESS. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING THE RESULTS AND FOR ANY DECISIONS OR ACTIONS YOU TAKE BASED ON THEM.

5. Intellectual Property Rights

5.1 Our Content

All content on our Site, including text, graphics, logos, images, software, and code, is the property of Mantravid.com and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our express written permission.

5.2 Your Data (Input)

You retain all ownership rights to the data, information, and files you submit to us for analysis ("Input Data"). By submitting Input Data, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, process, adapt, and store your Input Data for the sole purpose of providing the Service to you and improving our models (in aggregated, anonymized form).

5.3 Our Results (Output)

OWNERSHIP OF RESULTS: As between you and Mantravid.com, we own all right, title, and interest in and to the Results, insights, analytics, and reports generated by our AI models based on your Input Data. We grant you a non-exclusive, perpetual, irrevocable license to use the Results for your internal business purposes. You acknowledge that we may use the Results for our own business purposes, including improving our Service and creating aggregated datasets.

6. User Obligations and Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable laws or regulations.
  • Infringe on the intellectual property rights of others.
  • Transmit any material that is defamatory, obscene, or otherwise objectionable.
  • Attempt to reverse engineer any aspect of the Service.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use the Service to process data about individuals without their consent or in violation of privacy laws.

7. Payment, Subscriptions, and Refunds

7.1 Fees

The fees for our Service, whether one-time purchases, monthly subscriptions, or future pay-as-you-go credits, are as described on our Site. All fees are non-refundable except as expressly set forth in these Terms.

7.2 Payment Processing

We use Shopify and other third-party payment processors to bill you. By providing payment information, you represent that you are authorized to use the designated payment method and authorize us to charge you for the applicable fees.

7.3 Subscriptions and Automatic Renewal

If you purchase a subscription, your subscription will automatically renew at the end of each term unless you cancel it through your account settings or by contacting us prior to the renewal date. You authorize us to charge the then-applicable subscription fee to your payment method.

7.4 Refund Policy

No Refunds After 7 Days: For all purchases, including one-time fees, subscription fees, and future pay-as-you-go credits, you may request a full refund within 7 days of the initial purchase. After this 7-day period, all fees are non-refundable and non-creditable.

  • For EU/UK Users: If you are a consumer located in the European Union or the United Kingdom, you have a statutory right to withdraw from this contract within 14 days without giving any reason. However, you expressly agree that the Service will begin during the cancellation period and you acknowledge that you will lose your cancellation right once the Service is fully performed. By creating an account and using the Service, you acknowledge this waiver.

8. Cancellation and Termination

  • By You: You may cancel your account at any time through your account settings. Fees paid are subject to the Refund Policy above.
  • By Us: We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
  • Effect of Termination: Upon termination, your right to use the Service will immediately cease. Sections 5 (Intellectual Property), 9 (Limitation of Liability), and 10 (Indemnification) shall survive termination.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Mantravid.com SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR USE OR INABILITY TO USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; OR (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

10. Indemnification

You agree to defend, indemnify, and hold harmless Mantravid.com, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your Input Data caused damage to a third party.

11. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, to be held in Delaware. For EU/UK users, nothing in this section deprives you of the protection of mandatory consumer protection laws in your country of residence.

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on the Site. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.
